Henan car owner bought a Mercedes-Benz car to repair the middle cylinder of the engine. Unexpectedly, the Mercedes-Benz 4S store bought a "three-nothing" middle cylinder from the auto parts market to replace it. Finally, the car owner encountered the engine "cylinder burst" in the course of driving. In anger, the owner took the Mercedes-Benz 4S store to court and complained to Zhengzhou Market Supervision and Management Bureau. What on earth is going on? Let's have a look!

Recently, Mr. Cai of Zhengzhou City, Henan Province revealed that he wanted to protect the rights of his Mercedes-Benz, which started three years ago. In November 2016, Boss Cai spent 430000 yuan on a Mercedes-Benz E200L, which broke down after driving for half a year.

In July 2017, when there was a sudden torrential rain, Mr. Cai's car suddenly broke down, so he decided to be sent to the 4S store where he bought the car. Under the arrangement of the insurance company, Mr. Cai's Mercedes-Benz car was towed to Zhengzhou Huisheng Mercedes-Benz sales Co., Ltd. (hereinafter referred to as Huisheng Mercedes-Benz) for repair. the result of the inspection soon came out, and the other party said that the middle cylinder was broken and the cylinder block could no longer be repaired. It can only be replaced with a brand new engine, but the replacement of the engine is astronomical. Faced with the maintenance cost of more than 210000 yuan, the insurance company refused at the beginning.

Subsequently, someone introduced another authorized 4S store, "guarantee the use of original accessories and ensure quality", and then Boss Cai's Mercedes-Benz was handed over to this store. Until more than 2 months later, Boss Cai was informed to pick up the car. He thought it was over, but Boss Cai was furious.

After Boss Cai repaired the car and drove about 1000 kilometers, the car went on strike again. The Mercedes-Benz fault light suddenly came on, but how could there be a problem with the car that had just been overhauled? With all kinds of doubts, Boss Cai drove the car to the maintenance shop, but before it reached 4S, the car was completely paralyzed and the cylinder burst was broken halfway.

And the 4S store quickly gave an opinion: "if you still turn on the fault light, it is the driver's responsibility", meaning that they are not responsible. In a fit of anger, Boss Cai sued the store to the local market supervision bureau.

After an investigation by the staff of the Zhengzhou Municipal Market Supervision and Administration Bureau, it was found that the middle cylinder of Mr. Cai's Mercedes-Benz car, which had been replaced during previous maintenance, was a "three-free product", and the engine number on the middle cylinder was also privately engraved.

Subsequently, the court gave the following judgment: false one to three, with a total compensation of more than 170000 yuan. But Boss Cai believes that 170000 yuan is far from enough for his repairs. The first car repair costs 156 (from the insurance company) and the second repair costs 190000 (out of his own), plus the car rental fee of 60, 000 yuan, totaling more than 300, 000 yuan.

The court held that the insurance company and Huisheng Mercedes-Benz signed the "Insurance accident vehicle maintenance Cooperation Agreement", which had a special agreement on the use of original factory accessories for maintenance, and it was clear that the maintenance object was the customer's vehicle underwritten by the insurance company. And Huisheng Mercedes-Benz in the repair process without the consent of the plaintiff to use non-original parts, constitute fraud, should be compensated for 3 times the cost of the tank.

Mr. Cai said he would appeal the verdict. He said that the cost of compensation in the verdict "is far from enough to repair his own car, not to mention that it has been delayed for more than two years, and now the car cannot even enjoy the national insurance."
