The trial found that during the period from July 2016 to June 2018, the defendant Xiang served as head of the comprehensive department, director of data quality monitoring, and deputy manager of the automobile enterprise management department in the Shanghai New Energy vehicle data Center. He took advantage of his position in charge of verifying the data access compliance of new energy vehicle companies to seek benefits for others, and repeatedly accepted bribes in the form of cash and shopping cards, totaling more than 250000 yuan.

Among them, in July 2016, Xiang received a total value of 20,000 yuan from the staff of Chery New Energy Automobile sales Co., Ltd.; in November 2016, Xiang received a total price of 10,000 yuan from the staff of BYD Automobile sales Co., Ltd. in April 2017, Xiang received 10,000 yuan in cash from the staff of Zhejiang Geely Automobile Research Institute Co., Ltd., and so on.

On January 17 this year, the defendant Xiang took the initiative to go to the case handling site of the Supervisory Committee of Jiading District of Shanghai after being notified by telephone, took the initiative to explain the above main criminal facts when questioned, and also made a truthful confession after arriving at the case. After the incident, Xiang has returned the illegal gains.

The Shanghai Jiading District people's Court held that the defendant, Xiang, as an official assigned by a state-owned company to a non-state-owned unit, took advantage of his position to illegally accept other people's property many times and seek benefits for others, and the amount was relatively large, and his behavior constituted the crime of accepting bribes. The defendant Xiang, as a staff member of a private non-enterprise unit, took advantage of his position to illegally accept other people's property and seek benefits for others for a large amount, and his behavior constituted the crime of accepting bribes for non-state staff.

The defendant Xiang was finally convicted of accepting bribes and sentenced to seven months' imprisonment and a fine of 100,000 yuan; for the crime of accepting bribes to non-state functionaries, he was sentenced to eight months' imprisonment; it was decided to impose a fixed-term imprisonment of one year and a fine of 100,000 yuan.
