In March this year, Mr. Shang bought a 2011 second-hand Audi A4L at Guazi Yigao Store, Jiaxing Yigao Dian, at a price of 89500 yuan and paid a service charge of 6271 yuan. On the 20th of that month, Mr. Shang found a number of electrical faults in the car on his way back to Tongxiang, and then Mr. Shang contacted the insurance company.
Employees of the insurance company said the car was damaged by Typhoon Megi in September 2016, when the owner received a compensation of 155000 yuan.
Mr. Shang once inquired about the contact information of the owner of the car, Mr. Chen, through the Tongxiang branch of Pacific Insurance, and the other side confirmed that the car was indeed flooded during the typhoon.
According to Guazi's publicity materials, "after 259 professional tests, there were no major accidents, no fire accidents, no water soaking accidents," and it was written in the re-inspection contract that Guazi conducted an investigation on the car's soaking incident, all of which showed that it was qualified.
But in fact, it runs counter to Mr. Shang, whether it is Mr. Shang's door-to-door visit or regulatory mediation, Guazi has never given a clear answer.
Xu, manager of Guazi Hangzhou Branch, said that whether the car was soaked in water had to be identified. Although Mr. Shang provided the phone records of the insurance company and the original owner to prove that the car had been soaked in water, it was still necessary to provide relevant proof. Now, there are problems that can be registered, and the follow-up will be coordinated and solved by the specially responsible department.
Later, Guazi never responded again, and Mr. Shang did not agree to return the car. according to the contract, if there was a dispute, he could go to the people's Court of Haidian District of Beijing to resolve the dispute through litigation, so Mr. Shang chose to appeal and asked Guazi to return one for three.
On November 25, the case was heard in the Beijing Haidian District people's Court. Guazi admitted that the car was a bubble car, but Guazi belonged to the intermediary and did not have any responsibility in this matter.
According to the motor vehicle registration certificate, the original owner of the vehicle was Mr. Chen, which was resold to Mr. Zhang in Jiaxing in 2017 and to Ms. Zhang in Jiaxing on March 14, 2019. Nine days later, the car was finally sold to Mr. Shang. Therefore, Mr. Shang took Guazi, Mr. Zhang and Ms. Zhang as co-defendants.
Mr. Shang said that all the money for the car, including the car payment, service fee, license fee, etc., was handed over to Guazi's account. The car was also bought at the Guazi store. Guazi played not only the intermediary side in the transaction process. Mr. Shang specially visited the seller.
From the perspective of the contract, Mr. Shang is Party A, Ms. Zhang is Party B, and Guazi is Party C. from this point of view, Guazi is indeed the intermediary party, but is this really the case?
On the car purchase invoice, Mr. Shang saw Ms. Zhang's address and visited Ms. Zhang, but Mr. Shang was surprised by Ms. Zhang's explanation on the issue of vehicle ownership.
Ms. Zhang's husband said that at that time, her daughter worked in Guazi and temporarily transferred the car to her name, and a car could get a commission of 50 yuan, so he transferred the car to Ms. Zhang's name. Ms. Zhang's daughter left in April this year. I haven't got the commission yet. And the money of this car has not gone through their hands, and the signature on the contract is also signed by someone else, so they do not think that they are the owner of the car.
The situation is very clear. Ms. Zhang's daughter works in Guazi. After Guazi took the car in, she transferred the car in the name of someone else, and the actual operator was Guazi.
Guazi never responded to this matter before, saying that it was handled by Guazi's Public Relations Department, and this time he finally responded.
The Ministry of Public Relations said that this is not illegal, and the state does not have a temporary property rights registration law on arrival. In places like Hangzhou, where car owners hang up their cars and cannot sell them, car owners have to transfer their ownership to buy new cars, which is also to provide good service.
Guazi agreed to return the car, but Mr. Shang insisted on a return of one for three, because they did not admit that they had bought a problematic car, and publicity, testing, and guarantee were empty. Mr. Shang hoped that through this matter, let ordinary people buy cars on Guazi more carefully.
Mr. Shang said that he would make further plans after the verdict of the court.
Guazi claimed in the advertisement that "no middleman earns the price difference", "car owners sell more, buyers spend less", "259 tests" and other promises, but in fact, there are many problems, and the promises and tests are in vain.
Because of many problems, Guazi was exposed by CCTV in August this year, and then Guazi put forward "five rectification and reform measures", which are guaranteed for consumers to buy used cars, but the final implementation remains to be tested by the market.
Nowadays, the second-hand car market is mixed, especially the second-hand e-commerce platform, the promises and tests are empty. As a consumer, when buying a car, you must polish your eyes, inquire more and record more, so as to avoid disputes.
