According to media reports, Ms. Cao took a fancy to a Cadillac XT5 at the Wuhan Auto Show in November 2019 and asked the booth sales consultant about the purchase price. Ms. Cao said that after many times of communication between the two sides, the vehicle price was agreed to be 275700 yuan, and a car booking agreement was signed on the same day, and a deposit of 10,000 yuan was paid for the car, and the sales agreed that the pick-up date was before New Year's Day. Ms. Cao said that the salesperson at the auto show promised that there would be a special discount during the auto show, and that she would not get the discount after the auto show, so she paid the deposit and signed the car booking agreement during the auto show.

Ms. Cao said that after booking the car in November, she repeatedly asked the 4S store for the specific pick-up time, but was told that the order vehicle had not yet arrived at the store. Until December 27th, the sales staff of the 4S store took the initiative to contact and say that the car could be picked up at the store, but only if there was an extra charge of 6500 yuan, otherwise the car would not be taken out.

In view of the temporary price increase in 4S stores, Ms. Cao felt very confused and complained on the Internet.

A few days ago, the customer service staff of Wuhan Hengxin Xingkai Automobile sales and Service Co., Ltd. replied to the media that the customer booked the car during the auto show in November and the price was supported by the manufacturer. if the customer picked up the car in November, we could still go in accordance with the agreed price. however, because the customer picked up the car after the time of price support at the auto show, now the price has gone up, and the car can only be increased.

The customer service further said that the vehicle booking agreement needs to be signed by both the customer and the sales consultant, but Ms. Cao's vehicle booking agreement is only signed by the customer, and the sales consultant has not signed it, which is invalid.

From the car booking agreement provided by Ms. Cao, the two sides agreed that the price of the Cadillac XT5 28T luxury model is 275700 yuan, the deposit is 10,000 yuan, the delivery time is the car arrives at the store and the customer pays the full amount.

It is worth noting that the validity period of the pick-up time and price of the car is not specified in the agreement. At the same time, there is no company seal or sales consultant signature on the agreement.

In response to the problems with the electronic car booking agreement, Ms. Cao said, "the agreements are all operated by 4S stores on APP, and the contents are all written by them. I didn't think so much at that time, so I signed it first. I didn't know it was so dishonest."

Finally, after many negotiations, Wuhan Hengxin Xingkai Automobile sales and Service Co., Ltd. gave two solutions: one is that the customer continues to pick up the car, but must pay 6500 yuan; second, the customer chooses not to pick up the car and can refund the deposit of 10, 000 yuan.

There are different opinions on the Internet about the behavior of signing an agreement to pay a deposit and raising the price of the car.

A lawyer said that the behavior of the salesperson as an employee of the 4S store is an act of duty, and the agreement can be regarded as an invitation from the 4S store after the agreement is sent to the customer, and the customer signs the agreement as a commitment. At the same time, the customer paid the deposit, and the agreement was established and entered into force. The 4S store asked for a price increase when communicating with customers to pick up the car, indicating the de facto recognition of the effectiveness of the agreement. At the same time, the agreement does not take the pick-up time as a restriction on the preferential car payment, and the customer has the right to require the 4S store to continue to perform the agreement by bringing a lawsuit to the court.

Some people in the industry believe that "there is no spirit of contract, although this is the individual behavior of dealers, but it affects the image of the brand." According to the latest data released by Cadillac, its sales in December 2019 were 17707, down 17.05% from the same period last year, down 212507 in 2019 and 6.7% from the same period last year.
