The speed of the car dropped from 120km/h to 56km/h in an instant, and five fault codes jumped out of the big screen inside the car. According to Mr. Han, the brakes and throttle failed at that time, so he had to swing the steering wheel to make the car stop slowly by the side of the road.

Mr. Han's car was towed to Tesla Tianjin Wanggang Service Center for overhaul. the staff said that because it was a product of the previous generation, the insurance of the old model would indeed be like this, and now it has been replaced with a new model to ensure that such a problem will not occur in the future.

The service center quickly repaired Mr. Han's car, but Mr. Han said he never dared to drive the car again. Mr. Han repeatedly asked Tesla to show the condition of the car. At that time, the salesperson said many times that there was no safety problem with the car. Mr. Han was still unable to determine the safety of the car.

Under the mediation of the Tianjin market supervision and administration department, Tesla also provided a description of the condition of the car, saying that the car had "no signs of accidents or past accidents" and "no signs of structural maintenance."

It was suggested that Mr. Han conduct a comprehensive inspection of the vehicle, and Mr. Han went to Tianjin Wanfeng Motor vehicle Identification and Evaluation Co., Ltd. to identify the condition of the vehicle. On November 1, 2019, Tianjin Wanfeng Motor vehicle Identification and Evaluation Co., Ltd. released the appraisal results of Mr. Han's car. The appraisal opinion shows that there are many accident repair marks such as cutting and welding on the outer plate of the C-column of the car, which directly affects the collision strength and safety performance of the vehicle. In addition, some parts of the car body are repaired with black structural glue, the rear and rear lights of the charging port have metal debris residue, and there are scratches on the inside and outside of the car body, which belongs to the accident car.

In the first court confrontation, Mr. Han demanded that Tesla return 379700 yuan of the original car purchase and pay three times the compensation of 1139100 yuan for the car purchase, totaling 1518800 yuan, that is, "refund one indemnity three".

Tesla argued: after inquiry, before the transfer of ownership to the plaintiff, there was only one very minor vehicle collision and scratching accident, which only slightly injured the left rear leaf plate of the car body, the edge of the rear bumper and the surface of the hub, and did not damage the safety structure of the vehicle at all, so it did not constitute a "major accident".

Tesla also denied the problem of structural damage to the vehicle and believed that Tianjin Wanfeng Motor vehicle Identification and Evaluation Co., Ltd., which was unilaterally hired by the defendant, did not have the qualification of judicial authentication. the "appraisal" it provides to the plaintiff belongs to the commercial service provided unilaterally for the plaintiff, so its appraisal opinion has no legal effect. Therefore, Tesla sales did not carry out any objective behavior to defraud the plaintiff.

At present, the case is still waiting for trial. Industry insiders said that the frame is equivalent to human bones, if the main frame components of the vehicle, such as A-column, B-column, C-column and so on, are seriously damaged, even after repair, it will lead to a decline in collision strength and affect driving safety. Therefore, when buying a used car, consumers must understand the condition of the car clearly and require the merchant to produce written documents about the condition of the car, so as to avoid buying dangerous vehicles such as accident cars and blistered cars.
