However, although the price of the Harvard H6 is relatively low, 4S stores often charge for various items in the process of selling new cars, resulting in a big difference between the new car landing price and the manufacturer's price. Mr. Li in Zhoukou, Henan Province, encountered the situation of "arbitrary charges" in 4S stores.
In January this year, Mr. Li bought a 2019 Harvard H6 automatic elite model at the HongtenHarvard 4S store in Zhoukou, but unexpectedly encountered various "consumption patterns" of the 4S store in the process of buying the car, according to the financial website.
According to Mr. Li's description, when buying a car, the 4S store staff said that "ten or twenty thousand yuan can be used for a loan to buy a car." so Mr. Li paid 20, 000 yuan for a loan and drove the car away smoothly, but found that there are many clues after asking about the 4S store. 20, 000 yuan is not a down payment, but includes loan service fees, decompression fees, license fees, insurance, GPS and other fees, the real amount used for the down payment is only 3800 yuan.
To Mr. Li's surprise, after the 4S store paid 5066 yuan for commercial insurance, another "theft and rescue" spent 1933 yuan, and there was an extra "theft and rescue" out of thin air, so that Mr. Li's insurance expenses reached 7000 yuan. According to the payment screenshot provided by Mr. Li, the cashier of commercial insurance is Taiping property Insurance Co., Ltd., while the cashier of theft and rescue is Zhoukou Hongteng 4S sales and Service Company.
Mr. Li said that the naked price of this car is 94000 yuan. With interest and various fees, the landing price of the Harvard H6 has reached 128200 yuan, while the official guiding price is only 114000 yuan. In addition, most of the fees charged by 4S stores are not invoiced, not even a basic receipt, and more importantly, there is no formal car purchase contract for more than 4 months. In this regard, Mr. Li hopes that 4S stores can provide formal car purchase contracts and refund unreasonable fees.
In order to resolve the car purchase dispute with the 4S store, Mr. Li negotiated with the 4S store many times, but all of them ended in failure. The sales staff of the 4S store said that all charges, including loan service fees, were informed and agreed by Mr. Li. The manager of the 4S store said that he would come forward to help Mr. Li solve the problem, but said that the money could not be refunded. This is an agreement signed by both parties. All the charges are voluntary by Mr. Li. If he does not accept it, he can go through any legal procedures to solve the problem.
In addition, Mr. Li also called 400, and the customer service staff said that Mr. Li's situation had been recorded, but there was no follow-up news. Mr. Li also reflected the situation to 12315, but the staff said that the 4S store had a relevant contract with Mr. Li's signature on it, which could only be settled through negotiation.
With regard to the problems encountered by Mr. Li, the reporter contacted the sales staff of the 4S store to verify whether the relevant fees were informed in advance and did not provide car purchase contracts and invoices. He said that he did not know much about the details. I am just a part-time worker, and all matters are communicated between Mr. Li and the leader, and that everything he has done is in line with the provisions of the law.
As for the situation and demands encountered by Mr. Li, the lawyer said that if the 4S store had not been informed in advance, it might have violated consumers' right to choose and know, and consumers should also have a certain sense of safeguarding their rights. if they did not know but could not come up with the corresponding evidence, and the 4S store took out the contract and had the consumer's signature on it, it would be very difficult for consumers to safeguard their rights.
On May 14, the sales staff of the 4S store took the initiative to contact Mr. Li to coordinate the mediation. The salesperson said that the fee could be refunded, but it could not be fully refunded, only part of the fee (1000-2000 yuan) could be refunded and the leader should be asked for instructions. For the car purchase contract and the related expense invoice, the 4S store also refused to provide it on the ground of "asking the leader for instructions".
Through the 400 phone call, we learned that the car purchase dispute about Mr. Li and related demands have been recorded and handed over to Harvard for official settlement. Zhoukou Industrial and Commercial Organization also said that it has received a complaint from Mr. Li and the 4S store, and will organize both sides to adjust it later.
According to Article 10 of the measures for the Administration of Automobile sales, dealers shall not increase prices or charge additional fees in addition to the marked price; article 14 requires suppliers and dealers not to restrict suppliers and after-sales service providers of auto parts, supplies, finance, insurance and other products to consumers, and dealers may not force consumers to buy insurance or provide them with services such as vehicle registration. The relevant laws and regulations protect the legitimate rights and interests of consumers and the market order, but in fact, many dealers choose to evade, bundling consumption in the process of car purchase.
The behavior of "arbitrary charging" in 4S stores exists for a long time and cannot be cured. It has become commonplace for consumers to charge fees under the pretext of 4S stores, and many consumers are very helpless about this. Of course, it does not mean that 4S stores cannot charge fees. 4S stores help consumers handle business. There will certainly be certain costs in the process, and 4S stores are bound to charge corresponding fees for these costs, but the fees should be open, fair, transparent and voluntary. It should not make a profit through bundling consumption, which is harmful to both consumers and 4S stores.
