"Auto Home" is not only the abbreviation of the plaintiff's enterprise name, but also the name of the website. Meanwhile, the words "Auto Home" and "Auto Home to see cars, buy cars and use cars" have also been registered as trademarks, and Beijing Auto Home Company is the trademark owner.
Beijing Car Home Company found that Beijing Easy Car Internet Information Technology Company released mobile application software "Easy Car" in Apple Application Software Store, with the name displayed as "Easy Car-Professional Car Watching and Buying Car Home" and preview text description "Easy Car-Professional Car Selection and Car Buying Platform, Car Service Home for Car Friends". After downloading the software, it shows that its copyright party is Beijing Yiche Information Technology Company.
Plaintiff Beijing Chezhijia Company believes that Beijing Yiche Information Technology Company is the copyright party and operator of mobile application software "Yiche", providing car quotation, car friend community, car service and other services for car users. Both Auto Home and Easy Car are listed enterprises on the New York Stock Exchange, with the same main business, and are information service platforms for automobile users and enterprises. The original defendant has a competitive relationship in the field of automobile Internet service, while the mobile application software "Yiche" developed and operated by the second defendant arbitrarily uses the word "automobile home" in its name and text description, which causes misunderstanding and confusion, seriously infringes on the legitimate rights and interests of the plaintiff, disturbs the market competition order and constitutes unfair competition.
At present, Haidian court accepted the case, the case is under further trial.
