In early April this year, Mr. Zhou, the owner of Lexus, signed a car purchase contract with sales at Weigan Lexus 4S store in Baohe District, Hefei, agreeing to buy Lexus ES200 Precious Edition. According to the price agreed in the contract at that time, the guiding price of the car was 290000 yuan. However, during the car purchase period, Mr. Zhou was also asked by the store to install an additional 10,000 yuan of decoration in order to withdraw the car. In order to pick up the car as soon as possible, Mr. Zhou had to accept it.
It is understood that the 10,000 yuan decoration cost includes the whole car film, 360 °panoramic image, electric rear door, two suitcases, key chain. In addition, when Mr. Zhou applied for the loan, the store also charged a comprehensive service fee of 2000 yuan, a financial service fee of 6000 yuan, and a cumulative fee of 18000 yuan.
Surprisingly, the new car had been in use for only 23 days and the car spontaneously ignited at 02:10 on May 2. From the appearance, the vehicle is basically intact, but look at the car has been extensive damage, seats and floor mats are also burned. After the firefighters arrived at the scene and gave a preliminary determination as: "found that the vehicle is spontaneous combustion, non-artificial arson."
In addition, the owner and the staff of the Lexus 4S store, representatives of Lexus manufacturers and other appraisal institutions conducted three on-site and vehicle inspections, and extracted six relevant physical evidence, including wire harness. However, after the accident, the 4S store did not propose an acceptable solution to it. Weiqian Lexus 4S store only advised the car owner to settle the claim on the basis of spontaneous combustion, but because the commercial insurance taken out by Mr. Zhou did not cover the vehicle spontaneous combustion insurance, the claim could not be settled.
Due to the incident occurred for many days, the car owner has not received a reply, has contacted the 4S store and Lexus customer service, but the two companies did not respond accordingly. In the end, Mr. Zhou chose to tow the vehicle to the door of the Weigan Lexus 4S store to protect his rights, during which the two sides also clashed.
In mid-July, the owner of the car received an appraisal report, according to media reports: the point of fire was the lower position of the right seat in the front row of the car, and the cause of the fire was to rule out the possibility of foreign fire sources, remaining fires, lightning strikes, children playing with fire, and mechanical failures, and the possibility of fire caused by electrical circuit failure was not ruled out.
In this regard, Mr. Zhou went to the Lexus 4S store to negotiate and began to put forward the plan of "repairing the car" and "changing the car", which was rejected by the car owner. As the appraisal report shows that the direct loss of the vehicle caused by the fire is 140000 yuan, the 4S store also said that it will pay compensation at this price.
However, Mr. Zhou, the owner of the car, believes that the direct loss of his vehicle is close to 370000 yuan (car purchase fee, purchase tax, insurance, etc.), as well as a number of indirect losses, including late work fee, car rental fee, mental damage fee, and so on, so he cannot accept this proposal, resulting in no agreement between the two sides.
Until recently, there were media reports that Lexus had reached an agreement with the car owner Mr. Zhou, and Lexus agreed to the car owner's plan for full compensation, but as the two sides had signed a confidentiality agreement, the specific amount of compensation could not be known.
Although Lexus has always denied the existence of quality problems in the vehicle from the initial refusal of compensation to the period of full compensation, the car owner did not modify it in the normal use process, and the accessories were installed in the official 4S store in the later stage. At the same time, it is determined that the spontaneous combustion system is not a man-made factor. So it is only the manufacturers who know why Lexus agreed to pay compensation.
