Unable to pick up the car after full payment, the BMW 4S store was delayed again and again, and finally, after a number of consumer complaints, the local consumer council issued a consumption risk warning to consumers across the city-- be cautious about trading with Jingmen BMW 4S store. At the same time, the Consumer Council sent a letter of advice to the 4S store asking for a suspension of car sales.

According to the Jingmen Evening News, the Jingmen City Consumer Council received a complaint in July this year: 14 consumers paid full payment for a car at the BMW 4S store in May and June this year, and the 4S store promised to pick up the car within a week, but it has been delayed again and again since then. Delivery is a long way off. After receiving the complaint, the Municipal Consumer Commission intervened, and finally the BMW 4S store delivered 14 cars that had been delayed to consumers.

However, at the end of August, the Municipal Consumer Commission received complaints from six consumers who also paid full payment for a car at the BMW 4S store, all of which were delayed again and again, and failed to mention a new car within the agreed time limit, with the longest delay being two months.

Among them, Mr. Lu made a down payment to the 4S store on June 12, and the 4S store promised to pick up the car before the end of June for the first time. Due to failure to fulfill the contract, the 4S store postponed the pick-up date to the end of July, and then postponed it to August 10. The fourth promise is August 31, but Mr. Lu failed to mention the car in the deadline given by the 4S store.

In response, the Municipal Consumer Commission interviewed the general manager of the BMW 4S store Jingmen Baoze Automobile sales and Service Co., Ltd., asking it to deliver the vehicles to the six consumers by September 3. By the afternoon of September 3, none of the six consumers had been told to deliver the car.

Based on the above, the Jingmen City Consumer Council issued a consumption risk warning to consumers in the city through the news media on September 3. In view of the fact that Jingmen Baoze Automobile sales and Service Co., Ltd. is involved in a lawsuit involving repeated delays in delivery, it is currently in dispute with a number of consumers, and members of the public are advised not to trade with the company for the time being.

At the same time, the Municipal Consumer Commission served a letter of advice to Jingmen Baoze Automobile sales and Service Co., Ltd., which belongs to BMW 4S store. Since the beginning of this year, the company has violated the principle of good faith and, after consumers have paid the full amount of the car, cannot fulfill the obligation to deliver the vehicle in accordance with the agreement, and the refund request put forward by consumers has been deliberately delayed. In order to avoid damage to the legitimate rights and interests of consumers, the company is now required to stop car sales business. Cooperate with the Municipal Consumer Commission and the local market supervision department to investigate and deal with the lawsuit in the early stage.

It is worth noting that Jingmen Baoze Automobile sales and Service Co., Ltd. belongs to Zhengtong Automobile Service Co., Ltd. A number of 4S stores under Zhengtong Automobile Group have previously been exposed to a number of cases of non-delivery of cars in breach of contract, allegedly due to financial difficulties encountered by Zhengtong Automobile Group as the head office, the vehicle certificate was pledged in the bank and could not be redeemed, and the time for consumers to pick up the car is far away.

Prior to this, a number of 4S stores under Zhengtong Automobile Group appeared consumer rights incidents. Among them, in late August, a number of consumers pulled up banners in front of the BMW 4S store in Foshan Bao to plead for claims that the delivery of their BMW cars had been delayed several times.

Zhengtong Automobile Group is in operational difficulties. According to the performance report for the first half of 2020, Zhengtong Motor achieved a profit of 9.24 billion yuan, down 47.0% from the same period last year, while the loss attributable to shareholders was 1.365 billion yuan, compared with a net profit of 470 million yuan in the same period last year. In its first-half results, Zhengtong Motors revealed that it had opened a total of 127 4S stores and closed eight unprofitable 4S stores in the first half of the year.
