If OTA fails to effectively eliminate defects or cause new defects, producers should take recall measures again.

At the same time, when safety accidents such as intrusion and remote control of vehicles occur in the Chinese market, producers should immediately organize investigation and analysis and report the results of the investigation and analysis to the quality Development Bureau of the General Administration of Market Supervision.

With the development of automobile intelligence and network technology, automobile remote upgrade (Over-The-Air, hereinafter referred to as OTA) technology has been widely used.

In order to strengthen supervision, standardize the application of OTA technology in the recall work, and effectively ensure the personal and property safety of the people, according to the regulations on the recall of defective Automobile products and the measures for the implementation of the regulations on the recall of defective Automobile products, the relevant matters are hereby notified as follows:

1. From the date of issuance of this circular, producers (including enterprises lawfully established within China that produce automobile products and issue product certificates in their name, as well as enterprises that import automobile products from outside China and sell them within China) who carry out technical service activities on sold vehicles by means of OTA shall, in accordance with the regulations and the measures for implementation, submit them to the quality Development Bureau of the General Administration of Market Supervision for the record.

Producers shall supplement and record the OTA technical service activities implemented before the issuance of this circular from January 1, 2020 to December 31, 2020.

2. If the producer adopts the OTA method to eliminate the defects of automobile products and carry out the recall, he shall, in accordance with the requirements of the regulations and the measures for implementation, formulate a recall plan, put it on record with the quality Development Bureau of the General Administration of Market Supervision, and fulfill the main responsibility of the recall in accordance with the law.

If OTA fails to effectively eliminate defects or cause new defects, producers should take recall measures again.

3. Producers shall immediately organize investigation and analysis in accordance with Article 12 of the regulations when safety accidents such as intrusion or remote control occur in the Chinese market of vehicles produced, sold or imported or vehicles in the course of OTA implementation, and report the results of the investigation and analysis to the quality Development Bureau of the General Administration of Market Supervision.

4. If consumers, spare parts producers, software and systems or data service providers learn that producers use OTA to conceal vehicle defects and evade recall responsibility, they may directly report to the quality Development Bureau of the General Administration of Market Supervision.

Fifth, the quality Development Bureau of the General Administration of Market Supervision will organize relevant units to strengthen the research on automobile OTA safety supervision technology, explore the establishment of OTA supervision data platform, organize and carry out OTA safety technology assessment, and strengthen the relevant recall supervision work.

If it is found that the producer fails to file the relevant information or recall plan in accordance with the regulations, fails to cooperate with the defect investigation, conceals the defect, or fails to carry out the recall in accordance with the recall plan that has been filed, it will be dealt with in strict accordance with the law.
