In fact, it was only in 2016 that Toyota said publicly for the first time that it was under investigation for delays in submitting relevant reports to the Environmental Protection Agency (EPA). Toyota delayed the submission of about 78 reports on emissions defects involving millions of vehicles, according to the U.S. Department of Justice. In addition, the company did not submit 20 voluntary emissions recalls, meaning Toyota failed to submit nearly 300 reports between 2005 and 2015.

Although Toyota did not penalize larger vehicles for quality problems to carmakers such as Volkswagen, Daimler and FCA, Toyota evaded regulation by failing to report mandatory information to the EPA about potential defects in its vehicles, leaving the agency unclear. EPA believes that this mistake is a serious violation of the Clean Air Act. As Toyota's largest single market, most models sell well in the United States. According to Toyota North America's latest US sales figures for 2020, Toyota and Lexus sold a record 249601 vehicles in the US in December, up 20.4 per cent from a year earlier.
