Mr. Zhou said that when he bought the car, the 4S store did not tell him that it was in stock, and what he was most worried about was the quality of the car. Because it was an all-electric car, he spent a year and a half in the showroom worrying about battery life and safety.

To this end, Mr. Zhou offered to return the car to the 4S store, but it was rejected by the 4S store because Mr. Zhou had signed the car purchase contract and would not return the car if there were no safety and quality problems. However, Mr. Zhou said he had never signed the car purchase contract. Mr. Zhou said that when he finished paying for the car, the 4S store did not find me to sign the car purchase contract. Later, the 4S store sent a photo of the car purchase contract, but he did not sign the car contract or authorized others to sign it.

Generally speaking, only the signing of a car purchase contract can deliver the vehicle, why did not sign a car purchase contract to smoothly lift the car? Mr. Zhou said that at first, the sales of the 4S store posted a photo of the car purchase contract on Wechat, and he believed it at that time, but after the payment, the 4S store sales did not find Mr. Zhou to sign the car purchase contract.

The 4S store does not agree with Mr. Zhou's statement. 4S store sales staff said that when booking the car, it was clearly informed that the car was produced in October 2019, but it was only verbal. The salesperson said that the price of Volkswagen Bora Electric is 150000 yuan, but the price raised by Mr. Zhou is less than 100000 yuan. Mr. Zhou is aware of the price difference of 50, 000 yuan, but as to why it is so much cheaper, Mr. Zhou said the 4S store did not give specific reasons.

Mr. Zhou suggested that the 4S store forged its own signature on the car purchase contract in order to cover up the fact that the car was in stock. In this regard, the 4S store retorted that the signature on the contract was not signed by Mr. Zhou, but authorized by Mr. Zhou. 4S store staff said that because the customer paid for the car, which means the approval of the vehicle, so the car purchase contract was signed, but it was confirmed by Mr. Zhou before signing. However, Mr. Zhou also retorted that he had never authorized the 4S store to sign.

Due to the written basis, whether the signing of the car purchase contract is authorized has become a new question. In response to this incident, some legal personages said that the authorization can be based on oral and written, but from the current situation, there are loopholes in the practice of 4S stores, which may not be supported by the court from a legal point of view. However, as the two sides have reached a deal, it is impossible to return the car on the grounds that it is not authorized to sign a car purchase contract.

In response to the lawyer's opinion, the 4S store said that what Mr. Zhou is most worried about is the impact on the vehicle's battery for a long time, and there are safety problems, so the 4S store can consider extending the battery guarantee. At present, the two sides are still in further coordination.
