Article 14 of the regulations states that if the Ministry of Ecology and Environment finds that there may be emission hazards of motor vehicles during the supervision and inspection of the prevention and control of air pollution, the General Administration of Market Supervision and the Ministry of Ecological Environment may investigate the producers of motor vehicles, if necessary, the producers of exhaust parts may also be investigated.

Article 23 states that if motor vehicle operators receive the recall plan, they shall immediately stop selling or leasing motor vehicles with emission hazards, and cooperate with motor vehicle manufacturers to carry out the recall. The owner of the motor vehicle shall cooperate with the producer to carry out the recall. If the motor vehicle fails to complete the emission recall, the motor vehicle emission inspection institution shall remind the owner of the motor vehicle during the emission inspection.

How will our country implement the emission recall? According to Article 58 of the Law on Prevention and Control of Air pollution: "the State establishes a recall system for the environmental protection of motor vehicles and off-road mobile machinery." If the production or import enterprise learns that the emission of atmospheric pollutants from motor vehicles or non-road mobile machinery exceeds the standard, which belongs to design or production defects or does not meet the prescribed requirements for the durability of environmental protection, it shall be recalled; if it is not recalled, the market supervision and administration department under the State Council shall, in conjunction with the competent department of ecological environment under the State Council, order it to recall. "

Since the implementation of the Air pollution Prevention and Control Law on January 1, 2016, China has implemented six emission recalls, involving 5164 vehicles. The brands involved include Volkswagen, Mercedes-Benz, Subaru, BMW and so on, and the components involved include catalytic converter, fuel filling hose, exhaust manifold and OBD diagnostic software.

The first brand affected by regulators to implement emissions recalls was Volkswagen. On January 26th, Volkswagen (China) sales Co., Ltd. recalled 1950 imported Tuwei and Maiteng series cars according to the risk warning notice No. 2 of the former AQSIQ in 2015. Due to the installation of specific engine control module software, the exhaust emission test values of some vehicles in the recall range will be different from those in the actual road driving.

The first brand to initiate the recall was Mercedes-Benz. On July 31, 2019, Mercedes-Benz (China) Automobile sales Co., Ltd. recalled some imported GLE SUV and GLS SUV vehicles, totaling 308 vehicles. Within the scope of the recall, there is a mixed installation of exhaust catalytic converters, which can not meet the relevant requirements of vehicle emission standards and on-board diagnosis system, which may lead to alarm of on-board diagnosis system.

The State Administration of Market Supervision and Administration said that the emission recall is an international common practice, which has been implemented in the United States, Europe, Japan and other developed countries for decades, and has played an important role in reducing the emission level of motor vehicles and improving the effect of environmental protection. As the cost of emission recall may be higher than that of automobile safety recall, the regulation will bring greater economic and brand pressure to some motor vehicle enterprises, especially those with low level of emission technology in the short term. However, in the long run, the implementation of emission recall is an inevitable trend.
