AutoBeta(AutoBeta.net)06/21 Report--

Zhang, the "rights activist female car owner" of the Shanghai auto show, posted on Weibo on June 20 that she had been intimidated and attacked by cyber attacks, had collected evidence and would hold rumor mongers legally liable. In addition, it is hoped that Tesla will provide complete driving data as soon as possible to find out the truth of the accident, and then the incomplete data provided by Tesla will be released.

The following is the full text of Ms. Zhang's statement:

I'm being intimidated!

Recently, the exaggerated tone of some self-media ranging from "Lao Lai, underworld, human intimidation" to all kinds of so-called "shocking revelations" sounds as if he was in the accident car at the time of the accident. For the false remarks made on the Internet, some maliciously distorted facts, subverted black and white, taken out of context, and intended to slander me and my family, my team of lawyers has done a good job of preserving the evidence and will certainly investigate the rumor mongers for legal liability in accordance with the law. I have been silent not to give up the protection of rights, but to stop wasting public resources. My rights protection incident is still complaining to the state regulatory authorities in accordance with the law. I hope that Tesla can fulfill the regulatory orders as soon as possible in accordance with Chinese laws and regulations and provide complete data directly and unconditionally. Only with complete background driving data can we find out the truth of the accident.

Next, I will release the incomplete data provided to me by Tesla. Why would Tesla provide data that hides the key parameters?

Tesla, a female car owner in Anyang, Henan province, was sitting on the roof of her car on March 9, claiming that the brakes of her Tesla Model 3 car failed, resulting in injuries to her father and mother, according to related reports.

On March 10, Tesla customer support said that the speed of the vehicle before stepping on the brake pedal was 118.km/h, the ABS worked normally during braking, the front collision warning and automatic emergency braking functions started and played a role, and no abnormality of the vehicle braking system was found. in addition, Ms. Zhang refused to be identified by a third party and asked for compensation.

In response to Tesla, Ms. Tesla posted on Weibo on March 11 that the vehicle was not speeding and did not say it would not be verified by a third party, but that it needed an accreditation center rather than a quality certification agency. At the same time, it questioned the authenticity of the data, because 27 seconds 59 minutes later played 27 seconds 45 minutes, many times the playback recording is played in this way.

Tesla, a female car owner, was detained for five days after standing on the roof of Tesla's car and shouting "Tesla's brakes failed" at the Shanghai auto show. Subsequently, Tesla issued a statement saying that over the past two months, Tesla has always maintained active consultation with car owners, saying that he is willing to assist in completing testing, maintenance or insurance claims, and proposes a variety of solutions at the same time, but because the car owner does not accept any form of third-party testing, and strongly rejects all the proposals proposed. In response to Tesla's statement, Ms. Zhang said, "from March 27th to this morning (April 25th), Tesla has never communicated with us actively, let alone actively resolved the matter. I have never expressed that I will not accept third-party testing, but I will not accept the third-party testing agencies designated by them. "

On April 22nd, Tesla released the data one minute before the vehicle accident and made a written explanation. In response, Ms. Zhang said, "according to Article 8 of the Consumer Rights Protection Law, the data belongs to our car owners and should be handed over directly to us. Tesla's act of disclosing the data to the public without my consent violates our personal privacy as well as the legitimate rights and interests of our consumers." At the same time, Ms. Zhang questioned the source of the data, believing that the data released by Tesla and sent to the mailbox of car owners were not the original data. "Tesla is required to publish the data source, extraction method, production method and screening principles."

Tesla posted a "communication progress and incident description on Ms. Zhang's rights protection at the Shanghai Auto Show" on the morning of April 28, in which Tesla mentioned that Ms. Zhang refused "any form of vehicle testing", repeatedly mentioned "does not recognize third-party testing institutions", "brake failure or fraud", "too many people subvert black and white" and "pressure from the media if you don't return the car". Tesla said in the explanation that her husband, Mr. Li, said that only the test results would be accepted if the brakes failed, otherwise he refused to approve the test results.

In response to the relevant content mentioned in Tesla's release note, Ms. Zhang said in an interview with the media: "the statement issued by Tesla on April 28 is to change the topic and avoid the important points, and the core problem should go back to the vehicle itself. Tesla did not come up with a correct attitude to solve the problem. Their so-called apology is just for others, not to the car owner."

On the afternoon of April 30th, Tesla sent Ms. Zhang and his wife to communicate for the first time at the Municipal Regulatory Bureau, but there was no real progress in the communication between the two sides. Ms. Zhang said that she only hoped that Tesla would show her sincerity and provide the original and complete data of the vehicle before considering further compensation.

On May 6, Ms. Tesla issued a statement saying that she had formally sued Tesla (Shanghai) Co., Ltd., Tesla (Beijing) Co., Ltd. and Tao Lin, global vice president of Tesla Co., Ltd. the claims include a written apology from the three defendants to the plaintiff and a claim for 50, 000 yuan in compensation for mental damage.

On the evening of June 4, Ms. Zhang said in an interview with the media that the data provided by Tesla included nine parameters, including speed, brake pedal physical movement signal, brake master cylinder pressure, ABS signal, acceleration pedal displacement, steering wheel steering angle and so on. However, it believes that Tesla did not provide complete driving data, because by comparing it with the driving data of other accident riders, it was found that the data provided by Tesla lacked key data, including brake pedal displacement, motor torque and so on. Ms. Zhang believes that although the accident is different, this proves that Tesla actually recorded the relevant data and has the ability and responsibility to provide comprehensive data to car owners. Ms. Zhang said that Tesla responded that the law did not clearly stipulate that Tesla must provide complete data.

Tesla, a rights activist female owner of the Shanghai auto show, posted on Weibo in the early morning of June 9 that she had suffered a lot of personal attacks and stigmatization since the rights incident began, and some people slandered her with rumors such as Laolai and people who broke promises. In the face of more and more stigma, she no longer chooses to tolerate it and asks the relevant personnel to publicly apologize and eliminate the influence, otherwise she will adopt the law to protect her rights and interests.

It is worth noting that it has been more than two months since the incident, although Tesla and the car owner have released the relevant progress of the incident many times, but so far the two sides have not reached an agreement on the incident.
