AutoBeta(AutoBeta.net)08/20 Report--
On August 20, the State Internet Information Office, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Public Security and the Ministry of Transport jointly issued several provisions on Automobile data Security Management (for trial implementation), which will enter into force on October 1, 2021. Officials said that the purpose of the regulation is to regulate automobile data processing activities, protect the legitimate rights and interests of individuals and organizations, safeguard national security and social and public interests, and promote the rational development and utilization of automobile data.
The specific points are as follows: (1) the principle of in-vehicle processing, unless it is really necessary not to provide it to the outside of the vehicle; (2) the principle of no collection by default, unless set by the driver independently, the default setting is not to collect each time; (3) the principle of application of the accuracy range, determine the coverage and resolution of cameras, radars, etc., according to the data accuracy requirements of the functional services provided. 4. the principle of desensitization, such as anonymization and de-marking as far as possible. The "regulations" emphasize that when automobile data processors carry out important data processing activities, they should abide by the provisions on storing important data in China in accordance with the law, strengthen the security protection of important data, implement the requirements of the risk assessment and reporting system, and actively guard against data security risks; implement the requirements of the annual reporting system and take the initiative to submit annual automobile data safety management on time. If it is really necessary to provide important data abroad due to business needs, the automobile data processor shall implement the requirements of the data exit safety assessment system, and shall not provide important data abroad in violation of the conclusion of the exit safety assessment, and supplement the relevant information in the annual report.
The relevant responsible person of the State Internet Information Office also pointed out that the safety management of automobile data requires the joint participation of the government, automobile data processors, individuals, and other parties. In the process of automobile data security management, relevant departments above the provincial level, such as online information, development and reform, industry and informatization, public security, transportation, and so on, will strengthen coordination and data sharing to form a joint force. Netizens have expressed their support for this regulation. Some netizens said that all important data should abide by the regulations stored in the country, and if they violate the rules, please impose a heavy penalty. This is the bottom line that must be followed by the high-voltage line at all times.
In early April this year, "Tesla's car camera high-definition picture" was exposed. Judging from the exposed video, the camera in Tesla's car can clearly see the movements, postures and facial expressions of the driver and passengers in the car, but because the rearview mirror shell blocks part of the camera's view, the operation details cannot be recorded, and the picture of the rear window can not be recorded either. The video quickly sparked a heated debate after it was exposed, and many consumers began to worry about their driving data. The reason for this concern is that the driving data collected by Tesla are transmitted directly to the United States, questioning the confidentiality of user data on the one hand and posing hidden dangers to national security on the other. A more direct case is Didi. At the end of June this year, Didi officially went public in the United States, which was originally a big day for Didi, but there was no ceremony at all, and many people did not know that Didi was listed in the United States. However, there are certain risks in Didi's listing in the United States. after all, Didi, as the leader of domestic ride-hailing, has a lot of user information, so the choice of listing in the United States will inevitably cause regulatory vigilance. As a result, a number of Didi APP models have been removed from the shelves, operations have been suspended, and have been jointly reviewed by seven major departments in the country. Therefore, after the five major departments jointly issued the relevant regulations, many netizens also shouted Didi online.
Of course, the regulations jointly issued by the five departments are more aimed at the collection and management of smart car data. As cars become more and more intelligent, more and more attention has been paid to the data about cars. An intelligent car is equipped with radar, camera, positioning device, on-board interactive screen and so on. It is difficult for ordinary consumers to know how much user data, vehicle condition data and road environment data are collected during daily use. Ordinary consumers do not know how manufacturers manage data, let alone whether these data will involve user privacy or even national security. Therefore, the "regulations" issued this time can be said to put the data in a cage, and car companies cannot collect, store and process relevant data casually, which is conducive to the protection of user privacy and national security.
