According to previous reports, in August 2020, Mr. Chen, the owner of Tesla in Wenzhou, drove his own Tesla Model 3 to a sudden acceleration at a distance of 100m from the parking lot, crashing into more than a dozen cars before coming to a stop. The accident caused several cars to be damaged, and Mr. Chen's own Model 3 was also seriously damaged. The owner of the car, Mr. Chen, was successfully rescued after seven hours of rescue and was medically identified as a Grade 9 disability.

After the accident, Mr. Chen said that the accident was caused by the vehicle speeding out of control and crashing into the railing of the toll booth. At that time, his vehicle did not turn on autopilot. At first, the speed of the car was only 5km/h, then suddenly accelerated to 120km/h. The vehicle was suddenly out of control and the emergency braking had no effect. Mr. Chen also said that he had been an "old driver" for more than a decade and would never make the mistake of stepping on the accelerator as a brake.

Subsequently, the police commissioned the Wenzhou Society of Automotive Engineering, which is more authoritative in the judicial identification of local vehicles, to test and identify Mr. Chen's Tesla and issued a corresponding test report. At that time, the Wenzhou Society of Automotive Engineering released the results of the Wenzhou Tesla accident investigation: the car owner mistakenly stepped on the pedal and mistook the accelerator for the brake to cause the accident.

Regarding the accident caused by the car owner stepping on the pedal by mistake, Mr. Chen responded on social media: "in order to settle compensation for his neighbor, he was forced to ask the appraisal agency to write so." Mr. Chen said that under the persuasion of his friends, in order to settle the claim, he was finally forced to admit that he mistakenly stepped on the accelerator and caused the accident. As a result of this accident, he lost his ability to work, and the car owners who were hit by vehicles in the community often came to the door to collect debts, and they had to settle the compensation for NT $400,000 to NT $500,000, and they had no way to repay it. Mr. Chen posted the EDR test report of Wenzhou Society of Automotive Engineering on Weibo on July 14, and said he had recently received an indictment from Tesla, hoping that someone could help analyze the data. According to the EDR inspection report, Wenzhou Society of Automotive Engineering gives the appraisal opinions: 1, the braking system and steering system of small cars can not be dynamically tested due to accident collision damage, and no mechanical faults and safety hidden dangers are found in static inspection; the front lighting signal device is damaged due to accident collision, the working condition can not be tested, and the rear lighting signal device works normally. 2. The small car does not have the function of self-driving mode. after analyzing the collision data of the car, combined with the condition that the brake light is not on when it accelerates into the parking lot, the brake pedal did not work within 5 seconds before the accident collision.

In fact, there are many loopholes in Mr. Chen's remarks. First of all, if what Mr. Chen said is true, in order to be able to get the claim and beg the appraisal agency to attribute the cause of the accident to "the car owner mistakenly stepped on the pedal and mistook the accelerator for the brake to cause the accident", then it also means that the appraisal department also needs enough data to prove that the car owner can get the claim payment. Judging from the court's judgment, it was because Mr. Chen repeatedly said in online platforms or media interviews after the accident that "brake failure, automatic acceleration," and so on, Tesla thought that the right of brand reputation had been infringed, so he sued Mr. Chen to the court. In the end, the people's Court of Lucheng District of Wenzhou City ruled in favor of Tesla and asked Mr. Chen to apologize to Tesla and compensate Tesla for 50, 000 yuan on the top of his account on Douyin for 90 days. Mr. Chen has not yet responded to the verdict, nor has he issued an apology. Whether Mr. Chen will file an appeal will need to be further informed.
