AutoBeta(AutoBeta.net)12/25 Report--

After eight months, Tesla female car owner "car roof protection case" finally ushered in new progress. At 9: 00 a.m. on December 24th, the case of Ms. Zhang, the owner of Tesla's car roof, suing Tesla's reputation rights dispute was heard in the people's Court of Beiguan District, Anyang City, Henan Province.

This hearing is the first formal public hearing. Tesla is the defendant, and the two sides have had a heated debate for as long as six hours, but at present, the case has not been pronounced in court. Ms. Zhang, on behalf of the lawyer, said that the court will pronounce the sentence at an appointed time. At present, it is impossible to judge the result, and it is believed that the court will make a fair decision. In addition, in response to this trial, Tesla staff also replied: "We will actively respond to the lawsuit and respect the judicial judgment. Before that, we do not want to have too much interference and mislead public opinion."

It is worth mentioning that the focus of this public trial is not the brake failure of Tesla, but the prosecution of Tesla with reputation infringement. Ms. Zhang told the media: because there is not enough evidence to prove that Tesla's brakes failed, Tesla has always refused to provide all the data. Complete driving data is the key to the detection of vehicle problems. At present, we have not got all the information on the driving records. It is impossible to confirm whether there is a problem with the Tesla accident.

Here, let's first review the cause of the whole case. On February 21 this year, Tesla's car advocated that Ms. Tesla's Model 3 had a serious rear-end collision, resulting in her parents being injured and hospitalized. On March 9, a video of the car owner, Ms. Zhang, sitting on the roof of Tesla to safeguard her rights, sparked a heated discussion on the Internet.

At the Shanghai auto show in April, Ms. Zhang appeared at the Tesla booth wearing a T-shirt with the words "brake failure". On that day, Ms. Zhang stood on the roof of Tesla and shouted "Tesla's brakes failed." she was then forcibly dragged away from the scene by security guards and detained for five days for disturbing public order. Since then, Ms. Zhang has engaged in a fierce confrontation with Tesla on the vehicle issue, and Tesla's series of responses have also aroused widespread concern.

On May 6, Ms. Zhang submitted a civil complaint to the people's Court of Beiguan District, Anyang City. Ms. Zhang thought that some of the remarks made by Tesla and Tao Lin, vice president of foreign affairs of Tesla, infringed their reputation rights. Ms. Zhang believes that these false remarks have had a serious impact on the work and life of Ms. Zhang and her family, so she demands that the relevant personnel be investigated for legal liability in accordance with the law. He also claimed 50, 000 yuan in compensation for mental damage from Tesla. Tesla's infringement of Ms. Zhang's reputation involves: remarks made by Tesla and Tesla in response to the rights incident in relevant statements, as well as some remarks by Tao Lin, vice president of foreign affairs of Tesla. Some of the remarks include Tao Lin, vice president of foreign affairs of Tesla, who said in an interview: "she contributed all the recent negatives" and "We have no way to compromise." Is a new product development must go through a process "," she does not accept vehicle testing, must insist on high compensation, we have no reason to meet. I think she is also very professional, there should be (people) and so on.

After Ms. Zhang sued, on May 21, Tesla countersued Ms. Zhang for infringing her right of reputation and filed a case in the people's Court of Qingpu District, Shanghai. Tesla asked Ms. Zhang to issue an apology to the media and Weibo for infringing on her reputation rights at the Tesla booth at the Shanghai Auto Show in April, as well as a claim of 5 million yuan. The case has not yet been heard. As for Tesla's counterclaim, Ms. Zhang said that the Tesla incident had brought her a lot of negative effects, and the mental damage compensation that Ms. Zhang had asked the other party to pay would also rise from 50, 000 yuan to 500000 yuan, which was supported by the court.

Returning to the honorary infringement case mentioned at the beginning of the article, as of the day of the trial, Ms. Zhang still did not get all the information on the driving records. Ms. Zhang said that she "hopes to get the complete driving data at the time of the accident." As for the brake failure, Ms. Zhang submitted materials to the court in July, but there has been no progress due to problems in the jurisdiction of the court. In August, Ms. Zhang submitted a written request to the State Administration of Market Supervision and Administration to investigate the brake failure and received a reply that "the case has been filed", but because of the complexity of the case, it will take longer to get feedback.

In fact, Tesla is not the first time to experience the reputation infringement case between Tesla and the car owner. According to media reports, Tesla took Wenzhou owner Chen to court on June 9 this year on the grounds of maliciously slandering Tesla, while claiming 500000 yuan in damages for tort damages. On September 27, the female car owner of the Shanghai auto show claimed that she had also been claimed 5 million yuan by Tesla, also because of the reputation dispute in Tesla. However, the rights incidents triggered from time to time have not affected Tesla's sales in China. According to the latest figures, Tesla delivered 31732 vehicles in China in November, of which 26800 were sold in Model Y and 26100 in Model 3. In the first 11 months of this year, a cumulative total of 250141 vehicles were delivered, of which 413300 were sold in China for both Model Y and Model 3.
