Recently, the standing Committee of the Shenzhen Municipal people's Congress examined and approved the regulations on the Administration of Intelligent Network vehicles in Shenzhen Special Economic Zone. The regulations clearly stipulate that when an accident occurs in autopilot, the first responsible person is the driver. The L3, L4 and L5 levels of autopilot are divided into three technical levels: conditional autopilot, highly autopilot and fully autopilot. Clear requirements have been made for different classes of vehicles, which will be implemented from August 1, 2022.

The regulations stipulate that if a traffic violation or responsible accident occurs in a car with a driver's intelligent network, the driver shall bear the violation of the law and the liability for compensation; for a fully self-driving intelligent network car, if a traffic violation or responsible accident occurs during the period of no driver, in principle, the owner or manager of the vehicle shall bear the responsibility for violation of the law and compensation, but the relevant provisions of the driver's scoring shall not apply to the punishment of the offender. The vehicle status and surrounding environment monitored by the intelligent network can be used as an important basis for the determination of accident responsibility. In addition, the regulation proposes that if traffic accidents are caused by quality defects of intelligent network vehicles, drivers can recover compensation from the producers and sellers of intelligent network vehicles after they bear the liability for damages in accordance with the law. In other words, if the L3 or L4 autopilot system is turned on while the vehicle is running, if the vehicle has a traffic accident, the first responsible person is the driver.

It is worth noting that as early as March this year, Mercedes-Benz said that when a vehicle equipped with a L3-level Drive Pilot self-driving system turned on the auxiliary driving system, Mercedes-Benz would bear legal responsibility for the operation of the car. However, there are certain restrictions on this condition. Mercedes-Benz said that drivers do not have to look at the road ahead after turning on the Drive Pilot, and can even be distracted by playing with their mobile phones and watching movies, but the restrictions stipulate that the auxiliary driver will prompt the driver to take over if he senses something wrong, and if the driver does not take over, the driver will be held responsible. In other words, although the driver can relax slightly after turning on the auxiliary driving function, he still needs to be ready to take over the vehicle at any time, otherwise the responsibility still needs to be borne by the driver.
