He then found that a white Tesla rushed out of the road and knocked down the street lamp, tilting on the rest chair by the side of the road. The owner of the car had got off by himself and went to a safe location. There was no injury. Firefighters said, "the impact of the vehicle is relatively serious, we are worried that the vehicle caught fire, and the risk was ruled out after a round inspection." At the same time, firefighters found that the owner smelled of alcohol in the process of appeasing the owner. At this time, the traffic police who dealt with the accident also rushed to the scene and asked whether the owner was driving himself.

The owner did not admit that he was driving: "No, I didn't drive. I drove the car myself." According to the owner of Tesla, he ate and drank in Xixi Wetland that night, so he was ready to call a substitute driver, but he could not enter at the north gate of Xixi Wetland. Later, he sat in the passenger seat and used Tesla's automatic driving function to drive to the north gate. While driving, Tesla suddenly rushed out of the road, knocked down the lamppost and hit the roadside seat.

For the car owner's statement, Tesla believes that it is not true. Tesla staff said that the exact name of this function that Tesla has is "autopilot". According to Tesla's gravity sensing setting, the driver must sit in the driver's seat in order to turn on and use this function. Sitting in the passenger seat will not turn on this function. However, the staff member said that some users put heavy objects on the main driving seat to achieve the purpose of starting the autopilot function, and we do not recommend this, because when the car enters the autopilot, if the vehicle has an accident, it is still the full responsibility of the person, and according to the relevant provisions of the Road Traffic Safety Law, the driver should be in the driving seat of the vehicle.

In addition, Tesla said that the standard basic self-driving assistance system enabled by Tesla contains four functions, namely, keeping driving in the middle of the lane, keeping a distance from the car in front, cruising at a constant speed, and lane-assisted steering, all of which require human intervention to observe the surrounding road conditions, and this function is not suitable for all road sections, and there must be clearly marked road sections before they can be opened for use.

Tesla's statement has also been recognized by other car owners. A Tesla owner said, "I don't think it's possible. in order to enter autopilot mode, the necessary condition is to let the vehicle start and generate a certain speed per hour. Sitting in the passenger seat, how can the car start?" Another Tesla owner also said, "Tesla has gravity sensing on his seat and steering wheel. If he finds that he loses gravity sensing, Tesla will automatically withdraw from the autopilot function." Tesla car owner said, "when using the autopilot function, hands should be placed on the steering wheel, otherwise autopilot will be cancelled."

According to the relevant laws, at present, Tesla does not open the full autopilot function in China, but only opens the autopilot function, and the opening of the autopilot function requires the driver of the vehicle to be in the main driving position. hold the steering wheel and be able to operate and supervise the vehicle soberly.

In April 2021, the Ministry of Public Security openly solicited opinions from the public on the Road Traffic Safety Law (revised proposal), in which management requirements related to self-driving have been added, including the relevant requirements for road testing of cars with self-driving functions, as well as the determination of illegal behavior and accident liability of vehicles with self-driving and manual direct operation mode. In addition, the State Administration of Market Supervision and Administration issued the national standard "Automation Classification of Automobile driving" (standard number: GB/T 40429-2021) last year, which strictly defines driving automation, system and function, minimum risk status and strategy, intervention request and takeover, system failure, etc., and classifies auto-driving into levels 0-5 from multiple perspectives. Among them, L0 to L2 is the stage of auxiliary driving, which requires "human-computer co-driving", that is, the driving subject is still human, and the system only reduces the driving burden of human beings, while preventing emergencies or temporary intervention in driving in the event of an emergency.
