AutoBeta(AutoBeta.net)04/23 Report--

Four arrests, and Carlos Ghosn, the former Nissan chairman who has been repeatedly detained on different charges, has been criminally charged again by his former employer, Nissan. The Special search Department of the Tokyo District Prosecutor's Office sued Ghosn, 65, on the 22nd, accusing him of misappropriating $5 million (33.57 million yuan) of funds from Nissan for personal use, Kyodo News reported. Special dereliction of duty in violation of the Company Law.

Nissan announced on the same day that it had filed criminal charges against Ghosn, and prosecutors said they had collected enough evidence to convict Ghosn.

Ghosn's defense lawyer said it was a baseless charge that would be fully fought and that he had applied for bail. The court needs to make a comprehensive consideration before deciding whether to approve it or not.

According to the indictment, in July 2017 and July 2018, Ghosn asked Nissan, a subsidiary of Nissan, to pay a total of $10 million to sales agents in Oman in the Middle East, but that $500 was remitted to one of Ghosn's actual subsidiaries, causing losses to Nissan.

Nissan believes: "this misconduct is totally unacceptable, and Nissan demands severe punishment." Criminal charges were then filed against Ghosn.

Ghosn was charged last year with special dereliction of duty such as underwriting his director's remuneration in securities reports, violating the Financial Commodities Trading Act and passing on private investment losses to Nissan. After the third application for bail was first granted on March 5 and left the Tokyo detention facility on the 6th the next day, Ghosn had been detained for 108 days but was arrested again on April 4.

On April 3, while on bail, Ghosn made a video to prove his innocence, emphasizing his innocence and attacking Nissan's current management, saying they had messed up the business and then staged a dastardly coup to keep their position at the company.

At present, Ghosn has basically been removed from all positions in Nissan, Renault and the alliance.

It is reported that in the Ghosn era, Renault and Nissan were proposed to merge, but Nissan refused to merge, and the two companies have been playing a game on the dominance of the alliance. As a result of Ghosn's tough push for the merger, it has also been interpreted as the fuse for Ghosn to be sued by Nissan.

In Nissan's view, this is a just act to put an end to corporate chaos; in Mr Ghosn's view, it is a plot to seize power.

Renault is Nissan's largest shareholder, with a 43.4% stake. The French government owns 15 per cent of Renault and is Renault's largest shareholder, while Nissan owns about 15 per cent of Renault. According to Kyodo news agency, the French government wants Renault and Nissan to merge, but Nissan, which exceeds Renault in terms of business size, is disgusted with the merger in the form of Renault and is worried about the future of the alliance.

At the same time, Renault, under the leadership of the new chairman, Shennard, has once again proposed a business merger to Nissan, which Nissan still refuses.
