In July 2017, due to damage to the vehicle's water-related engine, the insurance company recommended that only the engine cylinder be replaced and repaired by Zhengzhou Huisheng Mercedes-Benz 4s store.

Until August 2018, the 4s store claimed to have negotiated and reached an agreement with Mr. Cai to replace the same new car and bear the purchase tax.

However, according to Mr. Cai, the premise of replacing a new car is that he admitted in the mediation agreement that the store had knowingly replaced the engine cylinder of his vehicle, which was not produced by the original factory, and he did not agree.

It could not be negotiated that the car was shelved in the 4s store for a year and a half. At the end of March this year, Mr. Cai did not want to wait and sent the Mercedes-Benz to other 4s stores to change the engine.

According to the Beijing News, Mr. Cai has commissioned a lawyer to sue Zhengzhou Huisheng Mercedes-Benz 4s store and put forward a claim to "return one for three." On April 18 this year, the Zhengzhou Erqi District Court accepted the case. In the lawsuit, Mr. Cai proposed that the Zhengzhou Huisheng Mercedes-Benz 4s store was ordered to refund the maintenance fee of 156000 yuan and compensate for three times the maintenance fee.

Industrial and commercial fine of 240000

The administrative department for industry and commerce of Zhengzhou held an administrative penalty hearing on the incident on April 2, pointing out that the subjective malice of Zhengzhou Huisheng Mercedes-Benz 4s store was obvious, which seriously damaged the legitimate rights and interests of consumers and disturbed the normal market economic order. The circumstances of the illegal behavior are bad. The administrative department for industry and commerce will confiscate 24430 yuan of illegal income and impose a fine of 244300 yuan, and the penalty decision will be issued recently.
