Mr. Chen, the plaintiff, alleges that he, a used car brokerage service center operator, bought a 2017 320iM sports BMW 3-Series used sedan in a car purchase service called "Speed shooting" mobile phone APP software developed by Golden edou Company. In the process of this purchase, the service provided by Guazi Company is called "professional and compensation service, there is no major error in testing 1000 vehicles, and the reinspector controls the car condition quality and condition is not consistent with the test, and the speed shot will pay the corresponding compensation." Mr. Chen launched the purchase order out of trust in the Guazi company's brand and after-sales guarantee. The second-hand car at that time showed that "the car is in excellent condition and belongs to 95B class" and "after testing, the car has no fire and no soaking water." The staff of the Hangzhou branch of Guazi Company contacted him, tested the situation of the vehicle on the spot and sent a Wechat video to Mr. Chen to watch. After confirming that it was correct, Mr. Chen paid the service charge and the rest of the car payment. And completed the transfer of ownership of the vehicle in Hangzhou.

Then, Mr. Chen sold the used car to his customer Hu at a price of 291000 yuan in Nanjing. After the sale, Hu found an anomaly while the vehicle was driving and went to the 4s store to check it. He found that the car had been out of danger in July 2017 and August 2017, in which the amount of compensation in August reached nearly 280000 yuan, and the claim was a full-loss car. Mr. Chen contacted the customer service of Guazi Company, and tested it to the Nanjing branch where Guazi Company is located, and concluded that the car was a water-soaking vehicle. In order to maintain goodwill and reduce losses, Mr. Chen refunded the second-hand vehicle purchased by Hu, and then negotiated with the melon subsidiary on how to deal with the vehicle.

Mr. Chen, the plaintiff, believes that according to the help Buy Service Agreement, it has formed a contractual relationship with Guazi Company, and Guazi Company shall be liable for breach of contract if it breaches the contract. In addition, it is in the "speed shot" APP software developed by the company to help buy services, and in many places, such as "help buy service common problems", "speed shot user agreement", "help buy service compensation rules" and so on, all record "speed shot" with the word "speed shot" will compensate and return the car according to the situation of the car source transaction, so it is believed that the company should bear the liability of compensation together with Guazi company.
