However, after more than a year, the smell not only did not dissipate, but became more serious. At the same time, after buying a car, Mr. Jiang's 4-year-old son became coughing and went to the hospital every three or five years.

"I took him to the hospital 26 times in more than a year," Mr. Jiang said. Acute bronchitis and increased lung markings were diagnosed three times, 42 kinds of drugs were used, and a total of 234 boxes of drugs were prescribed. At first, Mr. Jiang suspected that there was a smell from the floor mat and the car window film, so he changed the floor mat five times and a whole car film, but the smell was still there. He contacted the 4S shop and asked them to conduct a comprehensive investigation."

In November 2016, Mr. Jiang decided to dismantle his car for detailed inspection. Finally, Mr. Jiang identified the culprit-the damping sheet that emitted a very pungent smell. He thinks that if the source of the stink is not solved, the new cotton will become stinky cotton again in a year or two."

Mr. Jiang asked the factory to replace the inferior damping plate."Jaguar engineers said that the best solution is to remove the damping plate and paste it with a new one. At the end of 2016, a lawsuit was filed against the Jaguar manufacturer located in Pudong New District. The manufacturer then took 80,000 yuan, asked Mr. Jiang to sign a settlement agreement, gave 40,000 cash +40,000 repair coupons, and guaranteed to fix Mr. Jiang's car. However, Mr. Jiang didn't ask for it. Instead, he asked that the odor problem be completely solved." However, Mr. Jiang encountered jurisdiction problems during the lawsuit. His car was parked in the 4S shop for nearly a year, but even the court failed to file a case.

In February 2018, Mr. Jiang and his lawyer changed their litigation strategy and filed a lawsuit again to the court of Minhang District where the office of 4S Store is located. After that, it shall be handed over to the People's Court of Songjiang District where the contract is signed. On April 25, 2018, the Songjiang District Court filed a case for trial.

Mr. Jiang said,"They do not recognize the test results issued by ordinary third-party testing institutions, and they must be testing institutions with professional qualifications." But these agencies aren't taking my case. Even if it detects a problem, there is another obstacle--there are no mandatory standards for air quality testing inside cars."

On 25 July 2018, due to difficulties in collecting evidence, Mr. Jiang filed a complaint with the court and sought another way. Before withdrawing the lawsuit, Jaguar once again offered to compensate Mr. Jiang 30,000 yuan to reach a settlement. This time, Mr. Jiang's reply was still: Not accepted.

After giving up 80,000 yuan and 30,000 yuan settlement fees successively, Mr. Jiang went home and paid for himself to clean up the asphalt damper inside the car for the second time. "It took 20 days. In the end, I changed into new shock pads and cotton, and the smell was basically solved."

After Mr. Jiang summed up this rights protection incident, there are two difficulties: vehicle inspection, quality standards.
