Mr. Yu from Wuhan bought a 16 range Rover 3.0TV6 diesel version for 1.21 million in 2016. The car cracked on four wheels during the two-month warranty of the new car and stalled at high speed a year later.
At the beginning of 2016, Mr. Yu browsed to a parallel imported car sales company in Wuhan, and Mr. Yu took the initiative to leave contact information, and soon the staff of the other side contacted Mr. Yu to see the car in the company.
On January 23, 2016, Mr. Yu took a fancy to the 2016 range Rover diesel models in the company, and then the two sides signed a "passenger car sales contract". The contract reads: "Mr. Yu bought a black car with 16 Euro range Rover diesel 3.0T in installments at a price of 1.21 million yuan."
Mr. Yu took the vehicle away on February 1, 2016, and it was found in the documents such as the import certificate of goods and the inspection list of imported motor vehicles. All are British Road Tansheng 2993cc off-road passenger cars, made in the United Kingdom.
But when the vehicle has been driving for more than two months, there are quality problems. Between April 2016 and February 2017, the four wheels of Mr. Yu's range Rover cracked one after another, and he went to the garage for repairs several times. Finally, we went to the sales company of the vehicle to replace the four wheels and the sheet metal of the car body, and it was identified that the vehicle itself had quality problems.
On May 3, 2017, when it was raining heavily, Mr. Yu was driving on the Shanghai-Chongqing Expressway when a D-gear alarm appeared and the engine stalled. Mr. Yu then towed the vehicle to the sales company, and after negotiating with the sales company in vain, he sued the company to the Hanyang District people's Court.
Identified by the relevant departments entrusted by the court, the range Rover model purchased by Mr. Yu is made in the United Kingdom and belongs to the original imported model. However, the metal structure fatigue cracking caused by impurities and fine holes in the material of the hub is the quality problem of the hub itself and belongs to the product defect; as for the automatic flameout of the vehicle on the way and the non-alarm before flameout, the appraisal results show that the exclusion of engine damage caused by engine water involvement belongs to the quality problem of the vehicle itself.
In February 2019, the Hanyang District people's Court issued a judgment of first instance: revoking the passenger car sales contract and supplementary agreement signed between the two parties; Mr. Yu, the plaintiff, returned the vehicle involved to the defendant's sales company, and the sales company returned 1.21 million yuan to the plaintiff Mr. Yu for the purchase of the car, and compensated Mr. Yu for three times the purchase amount of 3.63 million yuan and other economic losses of 396000 yuan.
The sales company refused to accept the judgment of first instance and appealed to the Wuhan Intermediate people's Court. The Wuhan Intermediate people's Court held that the wheels delivered by the sales company frequently cracked and were identified as defective products, but the sales company concealed the product quality, which constitutes a sales fraud.
On May 2 this year, the Wuhan Intermediate people's Court issued a judgment of second instance, rejecting the appeal and upholding the original verdict, which is the final judgment.
For parallel imported cars, many consumers think that they are good and cheap, have the same import identity as the manufacturer, and the price is cheaper than the official sale. It has always been favored by users, but it is prominent that parallel imported models are difficult in all aspects of after-sale maintenance. Consumers should know more about imported models to learn more about them. And carefully read the terms of sale when signing the purchase contract to avoid consumer disputes.
