A car owner bought a new Volkswagen car and only drove more than 30 kilometers away, the engine made a strange noise, but he was refused to find the 4S store to return the car, saying that he could only replace the engine according to the three-package method. What exactly is the situation?

On May 26th this year, Mr. Hong spent more than 200,000 yuan on a Volkswagen CC at the Yingzhong 4S store in Minhou, Fuzhou.

On May 30, he went to pick up the car according to the notice of the 4S store. when Mr. Hong drove out of the car, he heard the engine "click" as soon as he stepped on the gas pedal, and then immediately returned to the 4S store for inspection, but the 4S store replied that the reason could not be found yet.

Mr. Hong, who has many years of driving experience, believes that the abnormal noise is obviously related to the engine, and under certain circumstances, the abnormal noise of the vehicle is more obvious, so he thinks that the problem of the vehicle will be very risky.

Mr. Hong said that the vehicle left the factory in February 2019, only more than three months after it left the factory, and it only ran more than 30 kilometers when there was a noise.

Because of the abnormal noise, Mr. Hong immediately sent the vehicle to the 4S store for comprehensive testing. The service staff of the 4S store said that they also heard the problem of the abnormal noise of the vehicle, so they fed the problem back to the manufacturer.

Three days later, the manufacturer replied to Mr. Hong a power of attorney, which read: "check the abnormal noise of the engine while driving and replace the short hair according to the approval." This means that the engine needs to be disassembled and replaced with cylinder blocks, pistons, crankshafts and other parts.

Mr. Hong said that he has also known that defects in the engine piston or cylinder block itself will cause a lot of problems, such as serious cylinder cracking and even a series of quality problems such as oil leakage.

Before picking up the car, the 4S store also showed Mr. Hong the documents such as the product certification of the vehicle, the vehicle consistency certificate and the pre-sales inspection card, but now the engine needs to be replaced, which is totally unacceptable to Mr. Hong.

Mr. Hong said that the abnormal noise as soon as it was produced must be the quality of the car itself. However, he complained about 4S stores through various channels, but he was evaded by all kinds of 4S, and his attitude was very tough that he could only replace the engine.

On June 17, Mr. Hong again found the person in charge of the 4S store, and the person in charge said that he had received a reply from the manufacturer that there was indeed an abnormal noise in the vehicle, so according to the three guarantees Law, it was to replace the engine for Mr. Hong.

When asked about the hidden danger of the abnormal engine noise in the 4S store, the person in charge of the 4S store said that the abnormal noise of the vehicle does not mean that there will be a safety hidden danger, and that three packages of cars can solve Mr. Hong's problem.

Mr. Hong said that the vehicle itself has quality problems and does not apply to the three-pack rule.

At present, the person in charge of the 4S store also admitted that there was negligence in the assembly of vehicles. However, we can only continue to feed back Mr. Hong's questions to the manufacturers, and other questions will not be answered.

According to Article 12 of the responsibility provisions for repair, replacement and return of Family Automobile products, sellers should deliver qualified household automobile products to consumers, that is to say, the premise of the three packages is that 4S stores must provide qualified cars.

Experts on automobile consumption also said that the abnormal noise in the engine of a new car, resulting in the need to replace and repair the engine, is a problem with the quality of the vehicle itself, and the three guarantees of cars are not applicable, and consumers can claim their rights and interests in accordance with the requirements of the contract Law and the Elimination Law.

Regarding this matter, the vehicle itself has the quality problem, but the 4S store does not want to cause the follow-up problem because of the return, unexpectedly repeatedly emphasizes to replace the engine according to the three guarantees law. Hope that the relevant departments can more standardize the industry regulations, not every time consumers encounter quality problems, 4S stores are said to be in accordance with the three-package procedure.
