According to Mr. Yan, when he was on the highway, he found that the skylight was broken when he opened the sunshade inside. So he returned to Shaanxi Yunhang Automobile Trading Co., Ltd. to find the reason, and several places where Mr. Yan went after picking up the car were monitored.

Mr. Yan said he had transferred surveillance in a total of three places. Among them, the hotels and gas stations all found that the glass was damaged when the vehicles went in and out. Finally, the surveillance in the dealership was called up and found that the staff drove the vehicle out of the store, and the video they drove away also showed damage points consistent with the location of the broken glass. For this, Mr. Yan believes that the cars in the dealerships already have quality problems.

Through two videos provided by Mr. Yan, one surveillance shows the Mercedes-Benz car parked in the store on June 30, and the other shows Mr. Yan picking up the car and driving away on July 1. In these two sections of monitoring, because of the distance, it is impossible to directly see whether the roof is damaged or not. However, when the vehicle is moving, it can be observed that there is an anomaly at the back of the roof skylight through reflection. But the store denied that the anomaly was not a damage point.

In addition, Mr. Yan also said that the purchase fee for his car was 555000 yuan, but the invoice issued by the store was 515000 yuan, which was also reported to the Inland Revenue Bureau.

Then the reporter and Mr. Yan came to Shaanxi Yunhang Automobile Trading Co., Ltd to understand. One of the account managers said the reflective anomalies in the video were just reflections. During this period, there was a dispute between the two sides and alarmed the police.

Therefore, the general manager of Shaanxi Yunhang Automobile Trading Co., Ltd. came forward to say that he believes that the staff in his store will clean and inspect the car every day, and if anything happens during the period, it will be solved in time, so there is no quality problem before the car is picked up. Also said that "surveillance video is only a circumstantial evidence, do not know what that point is, because I did not see that is a point, I think it is a mirror effect."

Zhao Liangshan, a public welfare lawyer: in view of the burden of proof of motor vehicle quality defects, according to Article 23 of the Consumer Rights and interests Protection Law, if a defect is found within 6 months from the date on which the consumer receives the motor vehicle, the economic side shall bear the burden of proof. If the operator is unable to obtain evidence, it will bear the legal consequences of the failure of proof.
