The regulations (draft) stipulate that motor vehicles that fail to pass the emission inspection are required to be repaired and re-inspected within a time limit after being punished. For those who drive on the road without maintenance and re-inspection within the time limit, their motor vehicle driver's license will be temporarily withheld for three months and fined 3000 yuan. At the same time, institutions that illegally provide motor vehicle emission inspection may be punished by rectification and suspension of inspection business.

There will be a fine of 3000 yuan if you fail to reinspect within the time limit.

The data show that there are 250000 heavy diesel vehicles in this city, and the average number of diesel trucks entering Beijing from other cities is about 30,000 times a day. Most of these vehicles are used for long-distance transportation, with large flow range, high intensity and large bicycle emissions. Nitrogen oxides and particulate matter emissions account for more than 70% and 90% of motor vehicle emissions, respectively, which are the key issues to be solved in this legislation.

The regulations (draft) stipulate that the city plans to improve the law enforcement mode of "environmental protection testing and public security punishment". When the public security traffic control department carries out supervision and inspection, the ecological environment department will carry out the test and issue the test results.

Specifically, motor vehicles or off-road mobile machinery used on roads within the administrative area of this city shall meet the relevant emission standards. In addition to stipulating that the public security traffic control department shall punish the unqualified motor vehicle on the road, it shall also carry out maintenance and re-inspection within seven days. For those who drive on the road without maintenance and re-inspection within the time limit, their motor vehicle driver's license will be temporarily withheld for three months and fined 3000 yuan.

The illegal operation of the inspection institution will cancel the qualification.

The regulations (draft) make it clear that motor vehicle emission inspection agencies will implement a cumulative points management system. For those who provide emission inspection in violation of the rules, measures such as suspending the inspection business and ordering rectification will be taken according to the scoring results.

The regulations (draft) stipulate that the departments of market supervision and administration, ecological environment and public security traffic control shall, in accordance with the division of duties, accumulate points for the illegal acts of motor vehicle emission inspection institutions and other acts that do not conform to the standards. If the prescribed score value is exceeded within a scoring period, the inspection business shall be suspended and the rectification shall be ordered; no certifying inspection data and results shall be issued during the rectification period. If it violates the relevant regulations, its qualification for metrological certification will be cancelled.

Illegal information will be included in the credit system

The regulations (draft) propose that the administrative departments in charge of traffic management of the municipal ecological environment, transportation and public security organs should share data and information such as motor vehicle emission inspection, emission standard maintenance, maintenance and reinspection. The municipal transportation administrative department shall publish to the public the catalogue of motor vehicle maintenance operators that have been put on record in this city according to law, and formulate maintenance service standards for motor vehicle emission standards.

The motor vehicle maintenance operator shall connect with the transportation administrative department to transmit the vehicle license plate, vehicle identification number, emission standard maintenance project and other information in real time, so as to truthfully record the maintenance of motor vehicle emission standards.

The law enforcement organ shall share the situation of the party concerned who violates relevant laws and regulations and is subject to administrative punishment or administrative compulsion to the public credit information platform of this city. The administrative organ may take disciplinary measures against it in accordance with the provisions.

Non-road mobile machinery will be registered by code

The term "non-road mobile machinery" as mentioned in these regulations (draft) refers to mobile machinery and transportable industrial equipment equipped with engines, including construction machinery, agricultural machinery, material handling machinery, airport ground equipment, etc. Excavators, bulldozers, loaders and road rollers are all included. The city has not yet implemented a non-road mobile machinery registration system, according to relevant departments estimated that a total of about 60,000 to 80,000 such mobile machinery, its mobility and use intensity is larger, compared with cars, pollution is more serious.

The regulations (draft) stipulate that heavy diesel vehicles and heavy gas vehicles sold and registered in this city, as well as non-road mobile machinery sold and in use, shall install remote emission management vehicle terminals and network with the municipal administrative department in charge of ecological environment. Long-term out-of-port heavy diesel vehicles driving in the administrative area of this city should also be equipped with remote emission vehicle terminals. Those who violate the relevant regulations may be fined 10,000 yuan per car.

With regard to non-road mobile machinery, the regulations (draft) make it clear that non-road mobile machinery used in this city shall encode and register basic information, pollution control technical information, emission inspection information and other information; if it is not registered, it shall be punished and recorded in the credit information record by the relevant departments, and the use supervision shall be strengthened by means of electronic tags and electronic fences.

Beijing, Tianjin and Hebei jointly build an information sharing platform for excessive emissions

It is worth mentioning that the regulations (draft) propose that this city will promote the establishment of a joint prevention and coordination mechanism for the emission of pollution from motor vehicles and off-road mobile machinery in Tianjin, Hebei Province and its surrounding areas, to carry out joint prevention and control in accordance with the requirements of unified planning, unified standards, unified monitoring, and unified prevention and control measures, and to implement the target responsibility for the prevention and control of air pollution.

Among them, the municipal ecological and environmental administrative department should strengthen cooperation with the relevant departments of Tianjin, Hebei Province and surrounding areas in the prevention and control of gas emission from motor vehicles and non-road mobile machinery, through regional consultation, information sharing, joint law enforcement, heavy pollution weather response, scientific research cooperation and other ways to improve the level of regional air pollution prevention and control.

Not only that, the city should also work with Tianjin and Hebei Province to formulate a random inspection plan for new vehicles to supervise and inspect the emission status of newly produced motor vehicles, the pollution control devices loaded, and the on-board emission diagnosis system; and jointly establish a Beijing-Tianjin-Hebei motor vehicle over-standard emission information sharing platform with Tianjin and Hebei Province to coordinate the supervision of motor vehicle excessive emissions.

Li Fuying, director of the Municipal Bureau of Justice, said that at present, Tianjin and Hebei Province are simultaneously promoting local legislation on the prevention and control of emissions from motor vehicles and off-road mobile machinery. In the early stage, Beijing, Tianjin and Hebei made a coordinated docking on the legislative content, and reached a consensus on the institutional framework, basic principles, main measures and legal responsibilities, especially on the relevant provisions related to regional coordination.

The National people's Congress proposes to increase the penalty for heavy diesel vehicles that exceed the standard.

Hao Zhilan, director of the Urban Construction Environmental Protection Office of the standing Committee of the Municipal people's Congress, said that it was learned from the survey that some heavy diesel vehicles repeatedly exceeded the standard and were repeatedly punished, and regarded the fine as a toll, which could hardly serve as a deterrent. It is suggested that penalties should be set for vehicles that exceed the standard on the road according to different models: a fine of 200 yuan for light vehicles in accordance with relevant regulations; for heavy diesel vehicles and heavy gas vehicles that exceed the standard, a higher amount of fine should be set, and heavy diesel truck pollution should be treated through heavy classics. do a good job in diesel truck pollution control.
