On July 29, the Beijing Chaoyang District people's Court announced the result of its first instance sentence in the case that 48 Touareg owners sued Volkswagen for engine flameout due to product design defects. The judgment found that Volkswagen did not clearly describe the product design defects, causing losses to Lan and others, and ordered Volkswagen to compensate Lan, Huang and Luo for 650000, 680000 and 630000 respectively, while the remaining 45 cases in which no actual damage occurred. Because Volkswagen has implemented recall measures to improve product defects, Volkswagen ordered Volkswagen to truthfully inform the contents of product defects and reject other requests.

Since June 2017, Volkswagen Touareg owners have found that there is a problem of engine water intake in their vehicles. Through experiments, some car owners have found that water enters the engine through the gap between headlights, which means that the reason for water intake is caused by the design defects of the vehicle itself. In response, 48 car owners rallied and took Volkswagen to court.

For this incident, Volkswagen said that the reason for the engine water intake is that the drainage valve may be blocked due to external reasons, thus unable to play the drainage function; when it is mentioned whether the gap between the vehicle headlights is a product design defect, Volkswagen adopted the vague statement that "Rain Water may flow into the intake pipe from the headlight gap" and did not explain the product design defects to consumers.

On March 14, 2018, the case was formally accepted by the people's Court of Chaoyang District, Beijing. After more than a year, the case finally announced its judgment of first instance yesterday. The court found that the problem of engine water intake of Volkswagen vehicles was a product defect, and as a producer, Volkswagen did not accurately inform consumers of the lack of design of the vehicle, which caused losses to Lan and others. Volkswagen was ordered to compensate Lan, Huang and Luo, whose products were damaged in this incident, ranging from 650000, 680000 and 630000 respectively. It is worth noting that although the court found that Volkswagen did not clearly describe the vehicle defect notice, it agreed that its solution to the product defect in the recall plan was effective. Therefore, for the remaining 45 car owners who caused actual losses, the court ordered Volkswagen to accurately inform Yang and others of the design defects of the product and reject other claims.
