According to the police, one person was killed and five were injured and four cars parked on the side of the road were damaged. The accident caused concern because the owner of BYD Tang DM said that "the vehicle was out of control and the brakes failed".

On April 29, BYD issued a preliminary accident description, saying that the brake lights were not lit in the collision and could be lit after the collision, and BYD fully cooperated with the traffic police to investigate and deal with the matter. According to the video of the driving record, BYD Tang suddenly accelerated after starting and drove at a high speed for more than 20 seconds, and finally collided with the opposite traffic after avoiding several times.

Ms. Zhou, the owner of BYD, said on Weibo that she had been driving for 11 years, and that after the car started, it suddenly went out of control and accelerated and did not respond when she hit the brakes continuously, questioning the quality of the BYD DM vehicle she was driving, so she filed a lawsuit with the court. According to media reports, Ms. Zhou's lawsuit against BYD has been accepted by the people's Court of Yanta District in Xi'an. Ms. Zhou asked the court to rule that the Tang DM made by BYD had quality problems, which led to traffic accidents.

The traffic accident, which resulted in one death and five injuries, caused great controversy when Tang DM owners questioned the quality problems of BYD cars, but many netizens believed that it was the consequence of "throttle acting as the brake". Ms. Zhou, the owner of Tang DM, also released the driving record video, which she believes can respond to netizens' questions about the driving ability of female drivers and the public opinion that female drivers panicked.

The video shows that the owner parked BYD Tang DM on the right side of the driveway at about 16: 58, the vehicle started and continued to accelerate, the speed of the car continued to accelerate, and after driving for a period of time, it collided with a white car coming in the opposite direction. During this period, the car owner controlled the steering wheel to avoid incoming cars and pedestrians, which lasted for more than 20 seconds.

After the accident, Ms. Zhou, the owner of Tang DM, said on Weibo that "the vehicle started in pure electric mode has just started from P gear to D gear, and before the brakes are loosened, the vehicle begins to rush forward quickly, and the vehicle is out of control except for the steering wheel, whether continuously stepping on the brakes or changing gears has no effect".

On April 29, BYD issued a description of the accident. According to the staff's investigation at the scene, it was found that the main and co-driver airbags, safety air curtains and side airbags all popped up; seat belt warning showed that the main driver did not wear seat belts; pedestrians hit by Zhou's driving vehicle have varying degrees of casualties. Synchronous attention to the external video of the accident scene shows that the vehicle brake light is not lit in the collision, and the brake light can be lit after the collision.

Identification: faster than 120km/h before the crash

An accident appraisal and analysis report of a relevant appraisal institution shows that the acceleration pedal stroke of the vehicle reaches 100% within two seconds, and the brake pedal state is zero, except that the recorded data at five collection times are missing during the period. The acceleration pedal stroke and brake pedal state remain unchanged within 22 seconds of starting. The speed has increased in 0-22 seconds, and the highest speed has reached 124.6km/h.

After 22 seconds, the recorded data remained unchanged, the brake pedal status reached 67%, the acceleration pedal stroke was still 100%, and the speed 120.5km/h. The content of the report shows that the data recorded after the collision is the last data sent before each module is offline, and all data remains unchanged. After disassembly and inspection of the brake pedal switch, it is found that the fixed root of the brake pedal switch has been broken.

The report also showed that on the day and the day before the accident, BYD's remote monitoring data "repeatedly appeared chaotic and contradictory brake pedal status data". At the same time, the vehicle monitoring data showed a "continuous large-scale state loss" before the impact, which was determined to be a problem with the system itself.

Another appraisal certificate issued by the Road Traffic accident Identification Center of the Institute of Traffic Management Science of the Ministry of Public Security shows that the driving braking system of the BYD DM vehicle involved is complete, and the vehicle is seriously damaged due to the accident, so it is impossible to carry out dynamic inspection, and the technical condition of the static test is normal.

The traffic police held the car owner fully responsible.

On July 8, the high-tech brigade of the traffic police detachment of the Xi'an Public Security Bureau issued a road traffic accident identification certificate, which found that BYD driver Zhou was operating improperly, speeding, and failed to drive safely in accordance with the operating standards. driving into the opposite lane is the direct cause of the accident. Zhou is fully responsible for the accident according to the relevant provisions of the Road Traffic Safety Law.

Car owner sues BYD

Mr. Li, husband of Ms. Zhou, owner of Tang DM, said that BYD's platform data had been missing many times before the accident, and the system had recorded many chaotic and contradictory brake pedal data the day before the accident. He suspected that there was something wrong with the vehicle at this time, so the data was no longer controlled by manpower when the subsequent accident occurred.

Ms. Zhou has filed a lawsuit in a people's court for questioning the quality of BYD Tang's DM vehicles, and Ms. Zhou posted a statement on Weibo.

As of press time, except for the preliminary investigation statement on April 29, BYD did not announce the progress of the accident investigation.
