Mr. Guo took the reporter to the 4S store to check on the damaged new car, and he could see that the right rear of the new car was seriously damaged, and the tires, wheels, doors, leaf panels and taillights were damaged to varying degrees.

Mr. Guo said that after he had booked the car, he gave the car to the 4S store to sign for the license plate, but he was hit like this when the license plate was not on. On the same day, the reporter also found the Guangzhou Automobile Honda Xintian 4S store in Fuzhou and learned that the cause of the accident was the collision of the rescue trailer which caused the new car to be hit.

The person in charge of the store said that it was because another customer's car had an accident and called a tow truck to rescue. After the vehicle was sent to the 4S store, during the unloading process, due to improper operation by the trailer driver, the handbrake may not be pulled, and the car slipped into Mr. Guo's new car.

The new car has become an accident car, which has given Mr. Guo a big headache, but the solution proposed by the 4S store has made Mr. Guo even more angry. It turned out that the 4S store gave two solutions at that time, the first one was that the store would repair the car and pay a further compensation of 2000 yuan. And Mr. Guo's original request for a new car, the 4S store said it could not do it, because the 4S store said they were not the first responsible party.

Second, there is a clear responsibility, the 4S store and the car owner should make a claim together with Lufeng Rescue Company, which belongs to the trailer that caused the accident. But such a statement, Mr. Guo obviously does not accept, Mr. Guo believes that the car has not been delivered, 4S store should do a good job of safekeeping.

At this stage, Guangzhou Auto Honda Xintian 4S store offered two solutions to car owners, but Mr. Guo still refused.

Legal personages have also been consulted on this matter, and the lawyer of Jintiancheng Law firm said that from the perspective of the contract Law, the risk of a new car accident is determined by whether the delivery of the new car has been completed, and if the delivery of the new car has been completed, then the risk point will be borne by the car buyer. If the delivery obligation is not fulfilled, it should be the responsibility of the 4S store. In this regard, the lawyer pointed out that the store should first make a compensation plan for Mr. Guo's vehicle, and then negotiate with the responsible party.

It is unacceptable for any owner to change a new car into an accident without mentioning it, and of course this is not a precedent. If there is an accident when a new car is not delivered, consumers should still seek legal advice to safeguard their own interests.
