Supplementary notice on accident report of New Energy vehicles

Relevant producers and units:

According to the Circular of the General Office of the General Administration of Market Supervision on further strengthening the recall Management of New Energy vehicle products (Municipal quality Supervision letter (2019) No. 531), in order to strengthen the safety recall supervision of new energy vehicle products, to further standardize the accident reporting system of new energy vehicles, the supplementary notice is as follows:

1. If a producer learns that a smoke or fire accident has occurred in the Chinese market of a new energy vehicle produced, sold or imported by him, he shall report the basic information of the accident to the quality Development Bureau of the General Administration of Market Supervision within 12 hours after the accident (if it causes casualties or significant social impact). It includes items 1 to 5 of the New Energy vehicle Fire accident Information Table (for trial implementation) (see annex). The producer shall report the New Energy vehicle Fire accident Information form (for trial implementation) to the quality Development Bureau of the General Administration of Market Supervision within 48 hours after the accident.

The producer shall keep the vehicle in the state after the fire accident rescue, so as to carry out the fire cause analysis and accident depth investigation.

Second, after the fire accident of new energy vehicles, producers should take the initiative to check whether there are fire safety risks in vehicles of the same model, batch or using the same parts. After investigation, if it is found that there is a fire safety hazard, the producer shall carry out the recall as soon as possible in accordance with the relevant provisions of the regulations on the recall of defective Automobile products and the measures for the implementation of the regulations on the recall of defective Automobile products.

Third, the defective product management center of the General Administration of Market Supervision will organize experts from the new energy vehicle accident investigation cooperation network to carry out in-depth investigation and analysis of vehicle fire accidents, defect risk assessment and determination according to the report of producer accident information.

The quality Development Bureau of the General Administration of Market Supervision will initiate defect investigation according to accident investigation and risk assessment, and issue risk early warning to consumers if necessary.

4. if a new energy vehicle causes a traffic accident due to the vehicle out of control or accidental acceleration, the producer shall promptly report to the quality Development Bureau of the General Administration of Market Supervision with reference to the above-mentioned time limit.

If the producer fails to report the accident information or practices fraud in time as required by this circular, the quality Development Bureau of the General Administration of Market Supervision will publicly inform the public, and shall be punished in accordance with the regulations on the Administration of defective Automobile products recall, the measures for the implementation of regulations on the recall of defective Automobile products and other relevant laws and regulations.
